How to Document Injuries for PIP After a Car Accident in Florida

Florida is a no-fault insurance state. That means after a car accident, your own Personal Injury Protection (PIP) coverage pays your initial medical bills — regardless of who was at fault. But there are strict rules about how and when you need to seek care for that coverage to apply.

Getting this right can be the difference between having your treatment covered and paying out of pocket. Here's what you need to know.

The 14-Day Rule

This is the most critical detail: you must seek medical treatment within 14 days of the accident to activate your PIP benefits. If you wait longer — for any reason — you may lose your right to PIP coverage entirely.

What PIP Covers

Florida PIP covers:

  • 80% of necessary medical expenses (up to $10,000 for emergency medical conditions, $2,500 for non-emergency)
  • 60% of lost wages
  • $5,000 in death benefits

The definition of "emergency medical condition" matters here. If your treating provider documents that your injuries constitute an emergency medical condition, you access the full $10,000 benefit rather than the $2,500 cap.

Who Can Treat You Under PIP?

How to Document Your Injuries Properly

Step 1 — Get a police report. Always file a police report at the scene if possible. This establishes that an accident occurred.

Step 2 — Seek care within 14 days. Don't wait. Come to our office as soon as possible after the accident.

Step 3 — Be thorough and specific about your symptoms. Tell your provider every symptom you're experiencing — even ones that seem minor. Pain, stiffness, headache, dizziness, trouble sleeping, anxiety — document all of it. Anything left off the initial record is harder to tie to the accident later.

Step 4 — Attend all scheduled appointments. Gaps in treatment raise red flags for insurance companies. Consistent care creates a consistent record.

Step 5 — Keep your own records. Photograph any visible injuries. Keep a pain diary noting daily symptoms, limitations, and how the injury affects your work and daily life.

Step 6 — Don't give recorded statements to the other driver's insurance. Their adjuster is not your friend. Consult an attorney first.
